Terms of Service

Governs your purchase and use of NearestPlane products and services

1. About Us

NearestPlane is a product of NearestPlane Limited, a private limited company registered in England and Wales.

References to "we", "us", or "our" in these terms refer to NearestPlane Limited. References to "you" or "your" refer to the customer or user.

2. Eligibility

You must be at least 18 years of age to purchase from NearestPlane. By placing an order, you confirm that you meet this requirement. If you are purchasing on behalf of a business, you confirm that you have authority to bind that business to these terms.

3. The Product

NearestPlane is a WiFi-connected LED matrix display that shows information about nearby aircraft using publicly available ADS-B data. The device requires a working WiFi connection and a suitable power supply (USB-C, 5V) to operate.

The device is intended for personal, informational, and recreational use only. It is not intended for use in aviation, navigation, safety-critical applications, or any environment where the accuracy or availability of flight data is relied upon.

Flight data accuracy: NearestPlane relies on third-party ADS-B data sources which are outside our control. We make no warranty as to the accuracy, completeness, or timeliness of the flight information displayed. Aircraft may not appear, may appear in incorrect positions, or may display incorrect data. Do not rely on NearestPlane for any purpose other than general interest.

4. Orders and Payment

All orders are subject to acceptance and availability. Placing an order does not constitute a binding contract until we confirm acceptance. We reserve the right to refuse or cancel any order at our discretion, in which case a full refund will be issued promptly.

Prices are shown in pounds sterling (GBP) and are inclusive of VAT where applicable. Payment is processed securely by Stripe — we do not store, handle, or have access to your card details at any point. Stripe's own privacy policy and terms govern the processing of your payment information.

For international orders, currency conversion and any bank charges are the responsibility of the customer.

5. Dispatch and Delivery

Each NearestPlane device is handmade to order. We aim to dispatch as quickly as possible, but during busy periods dispatch may take up to 14 days. You will receive a shipping confirmation email with a tracking number as soon as your order has been dispatched.

Delivery timescales once dispatched are dependent on Royal Mail and are outside our control. We are not liable for delays caused by the postal service, customs, or other circumstances beyond our reasonable control.

International customers may be subject to local customs duties, import taxes, or handling fees. These are the responsibility of the recipient and are not refundable by us under any circumstances.

6. Intellectual Property

All firmware, software, server-side code, website content, branding, and design associated with NearestPlane are the intellectual property of NearestPlane Limited and are protected by copyright and other applicable laws.

The firmware loaded onto your device is licensed to you for personal use on the device you purchased. You may not copy, redistribute, reverse engineer, decompile, or modify the firmware or any other NearestPlane software without our express written permission.

Over-the-air (OTA) firmware updates are delivered remotely to keep your device running correctly. By enabling remote management, you agree to receive these updates. We will never use OTA to deliver harmful, malicious, or unauthorised changes to your device.

7. Limitation of Liability

To the fullest extent permitted by applicable law, NearestPlane Limited shall not be liable for:

  • Any loss of data, loss of profits, or indirect or consequential losses of any kind
  • Inaccurate, missing, or delayed flight data from third-party ADS-B sources
  • Service interruptions caused by third-party data providers, WiFi issues, or internet outages
  • Damage caused by use of an incorrect power supply or improper handling of the device
  • Any loss or damage arising from your reliance on information displayed by the device

Our total liability to you in connection with any order shall not exceed the amount you paid for that order. Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

8. Third-Party Services

NearestPlane relies on a number of third-party services to function, including flight data providers, route data services, and Stripe for payments. We are not responsible for the availability, accuracy, or conduct of these services. Each third-party service is subject to its own terms and privacy policy.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any aspect of the NearestPlane service (including the server-side infrastructure, data sources, and OTA update system) at any time. We will always endeavour to give reasonable notice of significant changes. Your device will continue to function using locally cached data even if server connectivity is lost, though route lookups and remote management will be unavailable.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in another part of the United Kingdom, you may also have rights under the applicable law of that jurisdiction.

11. Your Statutory Rights

Nothing in these terms affects your statutory rights under UK consumer law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. These rights are in addition to, and not instead of, any rights we offer in our returns and warranty policy below.

Privacy Policy

How NearestPlane Limited collects, uses, and protects your information

1. Who We Are

NearestPlane Limited (company number 17253099) is the data controller for personal data collected through our website and devices. Our registered office is at 103 High Street, Waltham Cross, Hertfordshire, EN8 7AN.

We are registered with the Information Commissioner's Office (ICO) as required under UK GDPR. For any privacy-related queries, please contact us at hello@nearestplane.com.

2. What Data We Collect

We collect only the minimum data necessary to operate the service. Below is a summary of what we collect and why.

Important: Device data (location, WiFi SSID, device ID) is stored entirely separately from order data (your name and email). There is no link in our systems between a customer's identity and their device's location or WiFi network name. We cannot identify which customer owns which device from device data alone. When a customer contacts us for support, we may ask for their WiFi network name in order to locate the correct device — but this information is used only for that purpose and is not stored against their identity.

3. Legal Basis for Processing

We process your personal data on the following legal bases under UK GDPR:

  • Contract performance — processing your order, dispatching your device, and providing support
  • Legitimate interests — operating and maintaining the device server, delivering OTA updates, and monitoring device health
  • Legal obligation — retaining order records as required by law

4. How We Use Your Data

We use the data we collect to:

  • Process and fulfil your order, including arranging shipping
  • Send you order confirmation and shipping notifications
  • Provide technical support for your device
  • Deliver over-the-air firmware updates to keep your device running correctly
  • Monitor device performance and identify technical issues
  • Operate and improve the NearestPlane server infrastructure

We do not use your data for advertising profiling, sell your data to third parties, or share it with any party except where necessary to fulfil your order (e.g. passing your delivery address to Royal Mail).

5. Data Retention

  • Order records (name, address, email, order details): retained for 7 years as required for accounting and legal purposes
  • Device check-in data (performance metrics, error logs): automatically deleted after 24 hours on a rolling basis
  • Device configuration data (location, SSID, firmware version): retained for as long as your device is active on the network. You may request deletion at any time by contacting us
  • Support correspondence: retained for as long as reasonably necessary to provide ongoing support

6. Third Parties

We share data with the following third parties only to the extent necessary to provide the service:

  • Stripe — payment processing. Stripe handles all card data directly and is PCI-DSS compliant. We never see your card number. Stripe Privacy Policy
  • Postal and courier services — your name and delivery address are shared with our fulfilment carrier solely to dispatch your order
  • Cloud hosting infrastructure — our server infrastructure is hosted with a third-party cloud provider. Data is processed within the EU/UK
  • Flight data providers — we query third-party flight data services using your device's location coordinates to retrieve nearby aircraft information. No personal data about you is transmitted to these providers; only the location coordinates are used in the query

7. Cookies and Analytics

Our website uses Google Analytics and Meta Pixel (Facebook) for aggregate traffic analysis and advertising measurement. These tools may set cookies on your device. We also use Reddit's advertising pixel for the same purpose.

These tools collect anonymised information about how visitors use our website. They do not collect your name or contact details. You can opt out of Google Analytics via Google's opt-out tool.

8. Your Rights

Under UK GDPR, you have the right to:

  • Access the personal data we hold about you
  • Rectify any inaccurate personal data
  • Erase your personal data (the "right to be forgotten"), subject to legal retention requirements
  • Restrict how we process your data in certain circumstances
  • Object to processing based on legitimate interests
  • Data portability — receive your data in a machine-readable format

To exercise any of these rights, please contact us at hello@nearestplane.com. We will respond within 30 days. You also have the right to lodge a complaint with the Information Commissioner's Office if you believe we have not handled your data correctly.

9. Security

We take reasonable technical and organisational measures to protect the data we hold. Our server infrastructure uses HTTPS encryption for all data in transit. Access to the device management system is protected by multi-factor authentication. We do not store payment card data at any point.

No system is completely secure. In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify the ICO within 72 hours and inform affected individuals as required by UK GDPR.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The date at the top of this section indicates when it was last revised. Continued use of your device or our website following any changes constitutes acceptance of the updated policy.

Returns & Warranty

14-day returns · 6-month warranty (UK) · Lifetime support

1. Returns

You have 14 days from the date of delivery to return your NearestPlane for a full refund. The device must be returned in its original condition and packaging.

Please contact us before sending anything back. We will confirm the return, provide the correct address, and in many cases may be able to resolve any issue remotely without a return at all.

Return postage:

  • Manufacturing or technical fault: We cover return postage, or will arrange collection.
  • Change of mind: Return postage is the customer's responsibility. We recommend a tracked service — we cannot accept responsibility for items lost in transit to us.

Refunds are processed within 5 business days of receiving the returned item, to the original payment method.

2. Warranty

Every NearestPlane is covered by a warranty against manufacturing defects and hardware faults, starting from the date of delivery.

For warranty claims, please contact us first — we will always try to resolve issues remotely before asking you to post anything back.

3. Lifetime Support

All NearestPlane devices come with lifetime support from the person who built them. There are no bots, no ticket queues, and no expiry date. We will always do everything we reasonably can to help you get your device working — regardless of when you bought it.

Support includes: setup assistance, troubleshooting, remote firmware updates, settings changes, and general advice. Many issues are resolved remotely within hours without any need to post anything.

4. International Orders

International customers have the same 14-day return window, but a 3-month warranty. Return postage for warranty claims and change-of-mind returns is the customer's responsibility. Customs duties and import taxes are not refundable by us.

5. Your Statutory Rights

Nothing in this policy affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013. UK customers are entitled to goods of satisfactory quality, fit for purpose, and as described. Faults arising within 30 days of delivery entitle you to a full refund at your option.
